India has accused leading smartphone manufacturers Samsung and Xiaomi of colluding with major e-commerce platforms Amazon and Flipkart. Reports from the Competition Commission of India (CCI) reveal that these companies allegedly engaged in practices that undermine fair competition by launching exclusive products on the online platforms, thereby marginalizing smaller retailers across the country.
The CCI’s findings, outlined in two extensive reports, accuse Amazon and Flipkart of breaching local competition laws by preferentially selecting certain sellers, prioritizing specific listings, and offering steep discounts that disadvantage other market players. Such actions, as cited by CCI officials, have led to detrimental effects on the retail landscape, intensifying the challenges faced by smaller businesses.
The comprehensive investigation has uncovered a pattern of collusion among smartphone manufacturers, including Samsung, Xiaomi, Motorola, and others, in orchestrating exclusive phone launches. This behavior, described as anticompetitive, raises serious concerns about market practices that favor a select few at the expense of a broader consumer base. G.V. Siva Prasad, CCI’s additional director general, emphasized the harmful nature of exclusivity, stating it violates the principles of free and fair competition.
While Xiaomi has refrained from commenting, responses from Samsung and other implicated manufacturers remain unaddressed. Both Amazon and Flipkart have similarly stayed silent on the CCI’s findings, which allege that these companies downplayed the severity of exclusive launch practices during the investigation.
The CCI’s scrutiny comes as the Indian e-retail market is poised for explosive growth, projected to exceed $160 billion by 2028. With a market share nearing 36% between them, Samsung and Xiaomi represent two of the largest players in the smartphone sector. This investigation follows a complaint lodged in 2020 by the Confederation of All India Traders, which accused the companies of severely impacting offline retailers by restricting access to new models.
As the CCI prepares to review objections and finalize its findings, it may impose significant penalties and mandate changes in business practices for the involved parties. The ramifications of this investigation could reshape the competitive landscape of India’s thriving e-commerce sector and ensure a more level playing field for all retailers.
